The short version: we connect telephone calls and charge you by the second from a prepaid balance, that balance never expires and is refundable, there is no subscription, and we cannot call emergency services.
These terms are between you and Kliwe, LLC. By creating an account or using the service you accept them. You must be able to form a binding contract to hold an account.
You are responsible for your login and for everything done with it, including calls placed and balance spent. Tell us promptly at security@kliwe.com if you believe your account has been accessed by somebody else. Because the service is designed to be used from computers that are not yours, we strongly recommend ending your session when you finish on a shared or public machine.
Kliwe connects outbound telephone calls from your web browser to mobile and fixed-line numbers in the countries we carry, and optionally rents you an inbound number. It is not a mobile network, not a replacement for your telephone line, and not a messaging service.
Calls are carried in part over the internet and in part over the public telephone network. Quality depends on your connection and on networks we do not operate, and we cannot guarantee that any individual call will connect or be of any particular quality.
Kliwe cannot be used to call emergency services. It cannot reach 911, 112, 999 or any other national or local emergency number, and no setting, plan or payment changes that.
The reason is straightforward: emergency services are routed on the basis of where the caller physically is, and a browser-based service has no reliable way of establishing that. A call placed from a laptop in one country over a connection in another cannot be attributed to a location that an ambulance could be sent to.
You must maintain a separate means of contacting emergency services at all times — a mobile line, a fixed line, or a local SIM. By using Kliwe you acknowledge this limitation and accept that we are not liable for any inability to reach emergency services through the service.
Kliwe is prepaid. You add a balance, and calls are charged against it at the rate shown for the destination before the call connects. There is no subscription, no monthly minimum and no automatic recharge.
Calls are billed per second from the moment the call is answered, with no minimum duration and no connection fee. A call that is not answered is not charged. The rate displayed to you before dialling is the rate applied to that call; if the displayed rate and the charged rate ever differ, the displayed rate governs.
Your balance does not expire. There is no dormancy fee and no forfeiture of unused credit. You may request a refund of any balance you have not spent by writing to support@kliwe.com; we refund the unspent amount by the method you paid with, less any amount we are required to withhold by law or by the payment processor. Bonus credit granted on a top-up is promotional and is not refundable in cash.
Rates may change. Changes apply to calls placed after the change and never retroactively, and balance already on your account is never revalued.
Payments are processed by Stripe. Kliwe is the seller and the name on your statement; Stripe handles the card and its own terms apply to that transaction.
If you rent an inbound number, the monthly fee is deducted from your prepaid balance on each renewal date. There is no card kept on file and no subscription in the ordinary sense.
If your balance is insufficient on a renewal date, the number is released and the rental ends. You will not be invoiced, pursued for the amount, or considered to owe us anything — the number simply stops being yours, and it may then be issued to somebody else. Numbers are provided subject to the rules of the country they belong to, and some countries require proof of address or other documentation before a number can be issued or kept.
You may present a Kliwe number, a number you have verified as your own, or a number you rent from us. Verifying a number requires you to answer a call to it and enter a code, and by doing so you confirm you are entitled to use that number.
Presenting a number you do not control is unlawful in most jurisdictions and is grounds for immediate termination. Caller ID presentation is also subject to the rules of the country you are calling, and some networks will replace or discard it regardless of what you select.
You may not use Kliwe to:
We may suspend an account immediately where it is causing harm, appears to be fraudulent, or is generating traffic patterns consistent with abuse. Where circumstances allow, we will contact you first, and any balance on a suspended account that we determine was legitimately funded will be refunded.
We publish live availability at status.kliwe.com. We do not offer a guaranteed level of service, and we depend on carriers and networks we do not operate. Individual destinations can become temporarily unreachable for reasons entirely outside our control.
We process your data as described in the privacy policy. We never record audio, and written transcripts exist only if you switch them on. Call detail records are retained as required by law and are otherwise yours to export and delete.
We keep ownership of Kliwe — the service, the software, the documentation and the brand. Rented numbers are licensed to you for the period of the rental and are not sold to you.
The service is provided as described in these terms and otherwise without warranties of any kind to the extent the law permits. We do not warrant that any call will connect, that audio will be of any given quality, or that any destination will remain reachable.
Neither party is liable for indirect, incidental or consequential losses. Our total liability arising out of these terms is limited to the amount you paid us in the twelve months before the event giving rise to the claim. Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence.
You may stop using the service and close your account at any time, and request a refund of your unspent balance as described in clause 5. We may terminate for material breach that is not remedied after notice, or immediately where required by law or where clause 8 has been breached.
On termination, any rented numbers are released and your unspent balance is refundable in accordance with clause 5.
We may update these terms. For material changes we will notify account holders and update the date above before the change takes effect. Continuing to use the service after that constitutes acceptance.
These terms are governed by the laws of Delaware, and the courts of that jurisdiction have exclusive jurisdiction over any dispute.
